Sandgate Vaults, 35-37 Sandgate High Street, Sandgate, Kent, CT20 3AH Premise Licence

Report DCL/17/15 sets out the facts for the Licensing Sub-Committee to consider in determining a premise licence application. The licensing committee is the Licensing Authority acting in a role formally taken by the Magistrates Court. It is, therefore, not appropriate for officers to make additional comments other than in the capacity as a Responsible Authority under the legislation of the Licensing Act 2003. Therefore there are no comments from Legal, Finance or other officers included in this report

Report DCL/17/15 sets out the facts for the Licensing Sub-Committee to

consider in determining a premise licence application. The licensing

committee is the Licensing Authority acting in a role formally taken by the

The Environmental Health and Licensing Manager, Mr Arthur Atkins, presented the report to members.  He advised members that the applicants had agreed to the conditions set out by Environmental Health, which are detailed in the resolution below.  These conditions were read out to the Committee by Mr Wai Tse, Environmental Protection Officer.   Mr Atkins also reminded members there had been six representations received regarding this application. 

 

Mr David Scoble, applicant, spoke and explained the plans for a basement bar with waiting area and restaurant on the ground floor.  A planning application has been submitted for change of use for the basement area, however Mr Scoble believes there is existing planning consent for the restaurant area. 

 

Members questioned Mr Scoble and his colleague Mr Alan Neaves on parking issues, CCTV, staffing levels and noise.   Both applicants advised they are experienced in this trade and are fully aware of problems that can occur. They felt that they have support from local residents and were keen to continue building good relationships.  Mr Scoble and Mr Neaves are local residents themselves. 

 

Members heard from a local resident, Mr Bailey, who was concerned about noise, crime and disorder.  The applicant responded by mentioning the conditions set out by Environmental Health which he has agreed to.

 

The applicants and representatives were asked for any further comments before the sub-committee retired to consider the application. 

 

Following consideration of the application the Sub-Committee unanimously RESOLVED as follows:

 

1.  To receive and note Report DCL/17/15.

2.  Subject to planning consent for the basement area and confirmation that planning consent exists with regard to seating in the ground floor restaurant the licence to be granted based on the four Licensing Objectives:

 

·         The prevention of crime and disorder

·         Ensuring public safety

·         The prevention of public nuisance

·         The protection of children from harm

 

Subject to the following conditions:

 

·         No off-licence sales

·         No glasses or bottles outside

·         To cease serving drinks at 23.00 hrs and close at 23.30 hrs. 

·         To provide and display a notice detailing a contact number for residents and patrons.

 

Including the conditions agreed by the applicants to Environmental Health as given below:

 

·         Recorded incidental music only (amended from ancillary)

·         Signs must be placed up at entrances and exits to remind patrons to respect the neighbours and leave the site quietly

·         Similar signs reminding patrons to respect the neighbours and keep noise down to a minimum must be put up within the designated smoking area

·         CCTV operational during the hours of trading
