Right to transfer

The right to transfer from a local authority landlord to a private registered provider of social housing is governed by the Housing (Right to Transfer from a Local Authority Landlord) (England) Regulations 2013.

A local authority transfer to a private landlord involves a tenant-led process where a majority of tenants vote to transfer the homes to a private registered provider (PRP) of social housing.

These regulations compel local authorities to co-operate with a group of its tenants who wish to explore the benefits of a change of landlord.

This process is governed by specific regulations, requires a tenant ballot, and is subject to the Secretary of State's consent. The transfer must follow a strict process, including formal consultation and a ballot, to ensure it is viable and benefits the tenants.

The council can also request the Secretary of State to halt the proposal if it would have a significant detrimental effect on the authority's ability to deliver its housing services or regeneration within the local area.

If a transfer proves to be the favoured and viable option, the regulations compel the local authority to commence the process of transferring ownership of those homes to a private registered provider of social housing.
